Terms of Use

1. Acceptance of Terms

By accessing or using No 5 Writer™ (“the Service”), operated by MD&A INC. doing business as “Make More Creative” (“we,” “us,” or “our”), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use the Service.

2. Description of Service

No 5 Writer™ is an AI-powered writing studio that provides editorial coaching, genre-specific structural frameworks, and a manuscript editing environment for fiction writers. The Service uses artificial intelligence to generate suggestions, feedback, and structural guidance.

3. User Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years of age to create an account.

4. Your Content & Intellectual Property

You retain full ownership of all original content you create using the Service. This includes your manuscripts, character descriptions, outlines, notes, and all other creative work you produce. We claim no intellectual property rights over your content.

You grant us a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the Service to you. This license terminates when you delete your content or your account.

5. AI-Generated Content & Disclaimer

The Service uses artificial intelligence to generate editorial suggestions, structural guidance, research summaries, and other feedback. All AI-generated content is provided “as is” without warranty of any kind, express or implied.

No professional advice. AI-generated suggestions do not constitute professional editorial, literary, legal, or publishing advice. The Service is a creative tool, not a substitute for professional editors, literary agents, or legal counsel. You should seek independent professional advice for publishing, copyright, and legal matters.

No guarantee of accuracy or originality. AI outputs may be inaccurate, incomplete, biased, or inappropriate. AI-generated content may inadvertently resemble existing copyrighted works. We do not guarantee that AI suggestions are original or free from similarity to other published material. You are solely responsible for ensuring your work does not infringe on the intellectual property rights of others.

Research and factual claims. Research summaries and factual information provided by the Service may contain errors or outdated information. You must independently verify all factual claims, citations, statistics, and research findings before relying on them in your work.

Your responsibility. You are solely responsible for reviewing, editing, and deciding whether to incorporate any AI-generated suggestions into your work. Any decision to publish, distribute, or otherwise use content created with the assistance of the Service is made entirely at your own risk. We are not responsible for the outcomes of any publishing, business, or creative decisions made based on AI-generated content.

6. Billing, Refunds & Cancellation

Subscription billing. Paid subscriptions are billed in advance on a monthly or annual basis. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.

Non-refundable after credit usage. Due to the nature of AI processing costs, which are incurred immediately upon use, subscriptions become non-refundable once you have used any AI coaching messages or research queries in the current billing period. If you cancel after using AI credits, your subscription will remain active through the end of the current billing period, but no partial refund or proration will be issued.

Refunds before credit usage. If you have not used any AI coaching messages or research queries in the current billing period, you may request a full refund for that period by contacting us within 14 days of the charge.

Credit top-up purchases. Purchased AI credit packs are non-refundable. Credits never expire and carry over between billing periods.

Cancellation. You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. After that, your account will revert to the Free tier. Your manuscripts and data will be preserved regardless of plan status.

7. Acceptable Use

You agree not to:

• Use the Service to generate content that violates any applicable law
• Attempt to circumvent any security features of the Service
• Use automated means to access the Service beyond its intended interface
• Resell, sublicense, or commercially redistribute the Service
• Interfere with or disrupt the Service or its infrastructure

8. Third-Party Services

The Service integrates with third-party providers including Anthropic (AI processing), Supabase (data storage and authentication), and Perplexity (research). Your use of the Service is also subject to the terms and policies of these providers.

9. Service Availability

We strive to maintain the Service’s availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the Service at any time.

10. Limitation of Liability

To the maximum extent permitted by law, MD&A INC. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages arising from:

• Reliance on AI-generated content, suggestions, or research
• Publishing decisions made based on AI feedback
• Inaccuracies, errors, or omissions in AI-generated outputs
• Similarity between AI-generated suggestions and existing works
• Loss of data, manuscripts, or creative work
• Service interruptions or unavailability

Our total liability shall not exceed the fees you have paid to us in the twelve months preceding the claim.

11. Termination

You may terminate your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, you may request export of your content for a reasonable period. After that period, we may delete your data.

12. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Calgary, Alberta.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify users of material changes via the Service or email.
